According to Article 5 of the Nationality Law of the People's Republic of China, if both or one of the parents is a Chinese citizen and has settled in a foreign country, and he/she was born with a foreign nationality, he/she does not have Chinese nationality. He or she, as an applicant for foreign students, shall hold a valid foreign passport or a document certifying nationality for more than 4 years (inclusive) and have a record of actually residing in a foreign country for more than 2 years (actually residing in a foreign country for more than 9 months in a year can be counted as one year, based on the entry and exit stamps); immigrants to a foreign country from the mainland of China (Mainland China), Hong Kong, Macao, and Taiwan, as an applicant for foreign students the same requirement as above
